Who We Are

Miley is a software product operated by Kudos Technology, LLC. In these Terms, “Miley,” “we,” “us,” and “our” refer to Kudos Technology, LLC and the Miley service.

Use of Miley

You may use Miley only for lawful business purposes and only in accordance with these Terms, applicable laws, and the rules of connected messaging providers.

Customer Responsibilities

• You are responsible for the leads, contacts, messages, scripts, templates, account information, and instructions you provide to Miley.
• You are responsible for obtaining and documenting required consent before messaging consumers.
• You are responsible for honoring opt-out, unsubscribe, do-not-contact, and deletion requests.
• You are responsible for ensuring that your communications comply with real-estate laws, fair housing laws, advertising rules, privacy laws, telemarketing laws, and messaging-provider policies.
• You must not use Miley to send spam, deceptive messages, discriminatory messages, illegal content, or messages that violate provider rules.

Messaging Providers

Miley may integrate with providers such as WhatsApp, Facebook Messenger, Instagram, Twilio, Telegram, and similar services. Your use of those channels is subject to the applicable provider terms, policies, limits, review requirements, pricing, and enforcement actions. Where multiple laws, regulations, consent rules, or provider policies apply to a message, you must comply with all of them, including any stricter rule that applies to that channel, recipient, sender, use case, or jurisdiction. Miley does not control provider approval, deliverability, account status, message filtering, or policy decisions.

WhatsApp, Facebook, and Instagram

When you connect Meta messaging channels, you authorize Miley to send, receive, process, and route messages on behalf of the connected business, page, phone number, or professional account. For WhatsApp, business-initiated messages require valid opt-in where applicable, approved templates are required for business-initiated or out-of-window messages, and free-form replies may be limited to the applicable customer service window.

SMS and Consent

For SMS, you must obtain legally sufficient consent before sending messages and must honor STOP, HELP, and other opt-out requirements. You must ensure the sender identity, opt-in language, and message content accurately identify the party on whose behalf the message is sent.

SMS Messaging Terms

• Program name: Miley real-estate lead follow-up and conversation messaging by Kudos Technology, LLC.
• Program description: Kudos Technology, LLC, through Miley, and connected real-estate agents or brokerages may send lead follow-up, appointment, showing, property inquiry, account, and service-related messages through SMS or similar messaging channels.
• Message frequency varies based on lead activity, customer requests, and conversation status.
• Message and data rates may apply.
• Reply HELP for help or contact mileyappdev@gmail.com.
• Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, REVOKE, OPTOUT, or QUIT to unsubscribe from SMS messages where supported.
• After you opt out, you may receive one final confirmation message. No further SMS messages will be sent unless you re-subscribe or otherwise provide valid consent.
• Carriers are not liable for delayed or undelivered messages.
• SMS consent is not a condition of purchasing any property, service, or product.
• Our Privacy Policy explains how Miley handles personal information and mobile consent data.

AI Assistance

Miley may generate drafts, summaries, recommendations, lead scores, and other AI-assisted output. AI output may be incomplete or incorrect and must be reviewed before use where accuracy, compliance, or consumer impact matters. Miley does not provide legal, financial, mortgage, valuation, or real-estate brokerage advice.

Fair Housing and Non-Discrimination

You must not use Miley to create, send, target, exclude, route, or prioritize messages in a way that discriminates or suggests a preference based on protected characteristics, including race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, source of income where protected, or any other protected class under applicable law.

Account Security

You are responsible for safeguarding account credentials, limiting user access, and promptly notifying Miley of suspected unauthorized use. Miley may suspend access when necessary to protect the service, users, providers, or the public.

Data and Privacy

Kudos Technology, LLC handles personal information through Miley as described in the Privacy Policy. By using Miley, you authorize Kudos Technology, LLC to process information as needed to provide the service, operate connected channels, support AI features, maintain security, and comply with applicable obligations.

Human Escalation

If an automated or AI-assisted conversation does not resolve a request, a person may ask for human help in the conversation, contact the agent or brokerage directly, or email Miley at mileyappdev@gmail.com.

Fees and Third-Party Charges

Messaging providers may charge per message, template, conversation, phone number, registration, campaign, or account. You are responsible for fees described in your order, plan, or provider setup, including pass-through charges where applicable.

Suspension and Termination

Miley may suspend or terminate access if use of the service creates legal, security, provider, deliverability, compliance, or abuse risk, or if required by a messaging provider or applicable law.

Disclaimers

Miley is provided on an as-is and as-available basis to the fullest extent allowed by law. We do not guarantee uninterrupted service, provider approval, message delivery, lead conversion, AI accuracy, or compliance outcomes.
